Seller Agency

In Montana a “Seller Agent” is defined in the required relationships/consent in real estate transaction disclosure form.

Once a Seller signs an agreement with a “Seller Agent” then the Broker acts in the sole best interest of the seller in regards to selling real estate as defined in the Relationship in Real Estate and Listing Agreement.

A Seller Agent is obligated to provide the Seller certain duties and loyalties.

  • Follow all lawful instructions of the Seller
  • Use reasonable care and skill for the Seller
  • Comply with all federal, state and local laws
  • Keep confidential the Sellers confidences
  • Disclose relevant and material information that concerns the real estate transaction that is known to the Seller Agent
  • Act in good faith
  • Advise Seller when to seek legal or other expert advice
